Conditions of use

1. Introduction

1.1. These Conditions govern the access and use of the Website www.pompea.com.

1.2. The following terms have this respective meaning:
Conditions: these are the conditions of use of the Website;
User: a natural person who browses and uses the Website;

2. Access and use of the Website

2.1. By accessing, browsing or using the Website and its services, the User declares and guarantees that they are at least eighteen (18) years old and that they have read, understood and accepted Pompea’s General Conditions of Sale and the Privacy Policy.

2.2. If the User does not agree with Pompea’s General Conditions of Sale and the Privacy Policy they are requested not to access or use the Website.

2.3. Pompea reserves the right to suspend access or use of the Website if the User violates these Conditions of Use or if Pompea needs to take action for security purposes.

2.4. Pompea can update these Conditions of Use at any time: the User is required to check this page every time they access the Website to check for changes.

3. Intellectual property, software and content

3.1. The content of the Website - such as, by way of example, works, images, photographs, dialogues, music, sounds and videos, documents, drawings, logos and any other material, in any format, published there, including menus, web pages, graphics, colours, diagrams, tools, fonts and design, diagrams, layouts, methods, processes, functions and software of the Website - are protected by copyright and all other intellectual property rights.
3.1.1. Reproduction, in whole or in part and in any form, of the Website and its contents without the written consent of the Manager is prohibited.

3.2. The User is authorised to view the Website and its contents and to perform only temporary reproductions without economic significance which are considered provisional or ancillary to viewing the Website and its contents.
3.2.1. The User is not authorised to make any reproduction, on any medium, of the Website and its contents. Any reproduction must be, from time to time, authorised by the Manager or, if necessary, by the authors of the individual works contained on the Website, or by the holders of the exploitation rights. In any case, these operations of reproduction must be carried out for lawful purposes and in compliance with the copyright and other intellectual property rights of both the Manager and the authors of the individual works.

4. Brands and domain

4.1. All the distinctive signs and trademarks that distinguish the products sold on the Website are registered by Pompea, its affiliates or subsidiaries.

4.2. Any use that does not comply with the law of the above-mentioned trademarks and distinctive signs is unauthorised, prohibited and subject to civil and criminal penalties. In any case, it is prohibited to use the trademarks and any other distinctive sign of the Website to take unfair advantage of their reputation or in such a way as to harm them and their owners.

5. Privacy policy

The personal information provided by the User through the Website will be subject to Pompea’s Privacy Policy.

6. Personal profile

6.1. The User can create his/her personal Profile on the Website.
6.1.1. Without a Profile, the User may not be able to access or use some features, services or promotions offered by the Website.

6.2. To create a Profile, the User must enter an e-mail address, a password and his/her name and surname. Other optional data that the User voluntarily releases, expressing consent to the use described by the Manager in the specific information, will be processed according to Pompea’sPrivacy Policy.

6.3. The User is responsible for controlling access to his/her Profile and all activities that occur within it (including purchases), except in the case in which they have informed Pompea that the Profile has been used by third parties without his/her consent.

6.3.1. Pompea may terminate a User Profile used by third parties in violation of these Terms at any time and without notice.

7. Prohibitions

7.1. The improper use of the website is prohibited.

7.2.The following is forbidden: to transmit or disseminate viruses, trojans, worms, logic bombs, to publish abusive or technologically harmful material that violates privacy or is offensive or obscene; to alter data; to disturb other users; to violate property rights; to send advertising or otherwise unwanted material (such as Spam); to try to affect the performance or functionality of the IT structures of the Website or that can be accessed through it.

7.2.1. The breach of this provision may be a crime under the criminal code. The Manager reserves the right to report these violations to the competent authorities and to reveal the identity of the User involved.


8. Liability

8.1. Pompea takes all reasonable measures to ensure that the Website and its contents are free of viruses and defects, but Pompea cannot guarantee, and does not guarantee, that the User's computer, their hardware and software components or any data stored therein are not damaged, corrupted, lost or suffer other consequences as a result of accessing or using the Website.

8.1.1. The User is solely responsible for the security of his/her computer and should take all necessary precautions to protect his/her computer while using the Website, for example by installing reliable antivirus software.

8.2. Pompea is not responsible to the User for any loss or corruption of his data or damage to his computer.

9. Link to other websites

9.1. The Website contains hyperlinks (so-called links) to other websites that have no connection with Pompea and that are governed by their own general conditions of use and their own privacy policy.

9.2.  Pompea does not control or monitor these websites and cannot be held responsible for their content or policy, including their privacy policy and the processing of the user's personal data while browsing.


10. Other Website content

10.1. Pompea has taken every precaution to prevent content from being published on the Website that describes or represents scenes or situations of physical or psychological violence or such that, according to the User's sensitivity, can be considered harmful to civil convictions, human rights and dignity of people.

10.2. Pompea has also taken every useful precaution to ensure the User that the Website content is accurate and does not contain incorrect or outdated information with respect to the date of their publication and, as far as possible, even later. However, Pompea does not assume any liability towards Users for the accuracy and completeness of the Website contents, except in the case of Pompea’s misconduct and gross negligence and if differently provided for by law.

10.3. Pompea cannot guarantee that the Website will operate continuously, without interruptions and in the absence of errors or malfunctions due to the Internet connection. For any problems with the use of the Website, the User can contact the Customer Service for assistance and for restoring access to the Website, if it is possible.

11. Controversies

Any complaint or comment by the User regarding the Website can be forwarded to Pompea by contacting the Customer Service from the Contact Us dsection of the Website or by sending a request to customer@pompea.com.

12. Applicable law

12.1.These Conditions are governed by Italian law.

12.2. If one of these Conditions is invalid, null or unenforceable, it will be considered separable from the other conditions and won’t affect the validity and applicability of the other conditions.

12.3.The General Conditions of Sale  sare governed by the Italian law except for the User-consumer who does not reside in Italy, where the law of the country where the user-consumer resides will prevail and be applied.
